MICROSOFT MY BUSINESS MENTOR TERMS & CONDITIONS

  1. Instructions on how to enter this promotion form part of the conditions of entry. By participating, entrants agree to be bound by these conditions.
  2. The promoter is Microsoft Pty Ltd ABN 29 002 589 460 of 1 Epping Rd, North Ryde, NSW, 2113.
  3. Entry is open to Australian residents aged 18 years and over who are authorised representatives of an Eligible Business. For the purpose of this promotion, an "Eligible Business" is a micro-business, small business or sole trader operating in Australia that has:
    1. an Australian Business Number ("ABN");
    2. less than fifty (50) employees; and
    3. less than AUD $10 million in annualised revenue for the 12 months prior to the date of entry.
  4. Any business or sole trader that the promoter reasonably suspects not to be an Eligible Business or a genuine business with a valid business plan will be invalidated and will not be eligible to win any prize.
  5. Entrants must be available to attend the "Mentor Session" day to be held at Microsoft Flagship Store Sydney on Wednesday 05.06.19 (at a time to be determined by the Promoter).
  6. Employees and their immediate families of the promoter, its retailers, suppliers and associated companies and agencies are not eligible to enter.
  7. The promotion commences at 8:00am Sydney time on 13.03.2019 and closes at 11:59pm Sydney time on 07.05.2019 (“Promotion Period”).
  8. To enter, an authorised representative of the Eligible Business must, on behalf of the Eligible Business and during the Promotion Period:
    1. visit the Microsoft Store Australia Facebook page (www.facebook.com/microsoftstoreaustralia) and fill out all elements of the entry form pinned to the top of the page, including:
      1. provide a short summary (maximum 100 words) on your business and why you think you should win a spot at the mentoring day;
      2. provide a summary (maximum 50 words) on what you want to achieve/focus on in your discussion on with Naomi Simson at the mentoring day;
    2. submit the fully completed entry form; and
    3. all entrants will be eligible to redeem a special offer from H&R Block of AUD $300.00 worth of tax services from H&R Block (to be used toward business services, bookkeeping, a self-managed super fund ("SMSF") or towards a sole trader return.  Any applicable ASIC fee is not included and must accept to use Xero Software in order to access H&R Block’s bookkeeping package).
  9. The promoter reserves the right to verify the validity of entries and to disqualify any entrant whom the promoter believes either has tampered with the entry process or has submitted an entry otherwise than in accordance with these conditions of entry.
  10. All valid entries received during the Promotion Period will be reviewed by the judging panel between 08.05.19 and 13.05.19.
  11. This is a game of skill and chance plays no part in determining the winners.  Each entry will be individually judged based on strength, value, strategy, interest, diversity, growth and originality (“Judging Criteria”).
  12. Finalists will be announced on Monday 27.05.19 and notified via their nominated phone and email.
  13. Finalist prizes: The five (5) entries deemed to be the best by the judging panel will each win a place to attend the Microsoft Flagship Store Sydney SMB Mentor Session to be held on Wednesday 05.06.19 (at a time to be determined by the Promoter) which will feature representatives from Microsoft, H&R Block and Naomi Simson. Each winner will be allocated 30 minutes to sit with Naomi Simson one-on-one to discuss their business as outlined in their entry form.
  14. The judging panel may select additional reserve entries which they determine in their sole discretion to be the next best entries ("Reserve Entries"). The Reserve Entries may be selected to participate in the Mentor Session in the event a finalist is deemed to have submitted an invalid entry or is otherwise unavailable to attend the Mentor Session.
  15. The finalists will also have the opportunity to discuss product services with both H&R Block and Microsoft at the mentor day. If a finalist resides outside of NSW the prize will include return economy flights for one (1) person from the finalist's nearest capital city to Sydney, plus transfers to and from a nominated Sydney location.
  16. Total number of finalist prizes = 5. Prizes are not exchangeable, transferable or redeemable for cash.  Travel arrangements are at the promoter’s discretion and dependent on the winner’s nearest Australian capital city's airport.

  24. All meals, beverages, extra activities, spending money and all other ancillary costs (including travel insurance) not expressly provided, accommodation, as well as the cost of obtaining any of these, are the sole responsibility of the winner. In the event that the winner does not take an element of the prize at the time stipulated by the promoter, then that element of the prize will be forfeited and cash will not be awarded in lieu of that element of the prize. 
  25. All entries become the property of the promoter.  The promoter’s decision is final and no correspondence will be entered into. No responsibility is accepted for entries not received by the promoter. Entries will be deemed invalid if stolen, forged, mutilated or tampered with in any way.

Entrants warrant that their entry in the promotion does not infringe the intellectual property rights of any third party.  The entrant indemnifies and will keep the promoter and its associated agencies indemnified against any loss, costs (including legal costs), expenses or liability the promoter and its associated agencies may suffer arising out of a breach by the entrant of this clause.  
  27. Entrants may enter once only.
  28. The stated prize value is the recommended retail value (including GST, unless stated otherwise) in Australia as provided by the supplier and is correct at the time of printing. The promoter accepts no responsibility for any variation in the value of the prize. The promoter and its associated agencies and companies accept no responsibility for prizes damaged or lost in transit.
  29. Winners of all prizes will be notified via phone and email.
  30. In the event that a finalist position is not claimed by 5pm Sydney time Friday 31.05.2019 the judges will select an alternate finalist on the basis of the Judging Criteria.  In the event that the alternate winner does not claim their prize by 5pm Sydney time Monday 03.06.2019 then the prize will be forfeited by the winner and neither cash nor any other prize will be awarded in lieu of that prize.
  31. Before the prize is awarded, the winner will be required to sign a form to release the promoter from, and indemnify the promoter against, any and all liability arising from the use of or participation in the prize.
  32. Any costs associated with entering the promotion and accessing the website are the responsibility of the entrant.
  33. Failure by the promoter to exercise any of its rights contained within these terms and conditions at any time does not constitute a waiver of those rights.
